Tolerance and the Limits of Criminal Law
Resumen
The question that arises is what idea of tolerance was the basis of the proposals to tighten sec. 166 German Criminal Code (II.). It must also be clarified whether intolerant statements may also be reacted to with intolerance (III.). The answers to these questions finally lead to a more precise definition of the legal interest protected by sec. 166 German Criminal Code and the expression of public peace (IV.), whereby the final question arises, however, whether this norm is necessary at all (V).
